The court orders AstraZeneca to deliver less than EU demand

A Belgian court on Friday ordered pharmaceutical company AstraZeneca to deliver 50 million doses of its COVID-19 vaccine to EU members before 27 September, less than Brussels had demanded.

Both sides won, with the European Commission stressing that the company would pay a financial fine for each missed dose and the promising that he would easily accomplish the goal.

The UK – based pharmaceutical company failed to fulfill its EU supply contract in , delivering only 30 million of the promised 120 million.

But the court, despite being in favor of the European Commission’s demand for interim measures, only ordered the company to deliver an additional 50 million doses by the end of September.

If the company does not, it would pay a fine of 10 euros for an undelivered dose.

“This decision confirms the Commission’s position: AstraZeneca did not fulfill the commitments it made in the contract,” said European Commission President Ursula von der Leyen.

“It’s good to see an independent judge confirm that,” he said.

“This shows that our European vaccination campaign not only provides our citizens on a day-to-day basis. It also shows that it was founded on a solid legal basis.”

But in a statement from the company, AstraZeneca also welcomed the ruling.

“The European Commission had requested 120 million doses of vaccine cumulatively by the end of June 2021 and a total of 300 million doses by the end of September 2021,” the firm said.

“The judge ordered the delivery of 80.2 million doses on September 27, 2021,” he said, including the 30 million already delivered in the first quarter in his calculation.

“To date, the company has supplied more than 70 million doses to the European Union and will substantially exceed 80.2 million doses by the end of June 2021.”
